Agreement to terms

By creating an account or using GoneUP ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms are a legal agreement between you and GoneUP LLC ("we", "us", "our"), a Tennessee limited liability company.

Eligibility

You must be at least 13 years old to use GoneUP. If you are under 18, you represent that a parent or legal guardian has reviewed and agrees to these Terms on your behalf.

Your account

To use certain features, you must create an account with a valid email address and password. You are responsible for keeping your login credentials secure. You are responsible for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

Your data

You own your data. Grocery lists, trip history, meal plans, price data, and any other content you create in the App belongs to you.

By using the App, you grant us a limited license to store, process, and display your data solely to provide the service to you. We do not sell, rent, or share your data with third parties for advertising or marketing purposes.

Your data is stored locally on your device and, if you are signed in, synced to our cloud infrastructure (Supabase) for backup and multi-device access. You can delete your data at any time by clearing your browser storage or contacting us to delete your account.

Acceptable use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to access other users' accounts or data
• Reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the service or its infrastructure
• Use automated tools to scrape, crawl, or extract data from the App
• Misrepresent your identity or impersonate another person

The service

GoneUP is a personal grocery planning and price tracking tool. Price estimates are based entirely on your own trip history. We do not guarantee the accuracy of any price estimate, trend, or insight. The App is not a financial advisor.

We may update, modify, or discontinue features at any time. We will make reasonable efforts to notify you of significant changes.

Beta disclaimer

GoneUP is currently in beta. The service may contain bugs, experience downtime, or change without notice. By using the beta, you acknowledge that the App is provided on an "as-is" basis and that features may be added, changed, or removed.

Subscriptions and pricing

GoneUP offers a free tier and a paid Pro tier. Pricing, features, and trial terms for Pro are displayed within the App and on our website. Pro subscriptions are not yet available. When they launch, payment processing will be handled by a third-party provider (such as Apple, Google, or Stripe). We will update these Terms before paid subscriptions become available.

Intellectual property

The GoneUP name, logo, design, and source code are the property of GoneUP LLC. You may not copy, modify, distribute, or create derivative works from any part of the App without our written permission.

Limitation of liability

To the maximum extent permitted by law, GoneUP LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, but is not limited to, loss of data, loss of profits, or inaccurate price estimates.

Our total liability to you for any claim arising from these Terms or your use of the App is limited to the amount you have paid us in the 12 months preceding the claim, or $50, whichever is greater.

Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Termination

You may stop using the App at any time. You may delete your account by emailing hello@goneupapp.com.

We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the App ceases. Sections on liability, warranties, and governing law survive termination.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email before the changes take effect. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law provisions. Any disputes arising from these Terms will be resolved in the state or federal courts located in Wilson County, Tennessee.
